Custody evaluators are the psychologists and social workers who interview parents, observe children, run testing, and produce reports that family courts often follow with little independent scrutiny. They are presented as neutral experts, professionals applying clinical judgment to high-conflict cases. The research on their actual outputs tells a more uncomfortable story. The recommendations these evaluators produce correlate strongly with which parent retained them, and the methodologies behind their conclusions often fail basic standards of validity. None of that means evaluators are bad people. It means the structure they work in produces predictable bias, and family courts are still treating their reports like neutral findings.
The structural problem with the role
A custody evaluator is paid by one or both parents, often by the parent who initiated the evaluation, and produces a report that benefits one side more than the other. Even with court-appointed evaluators, the parties are typically responsible for the bill, and the evaluator depends on referrals from family law attorneys for future work. That referral economy is small, and attorneys notice which evaluators tend to favor their clients. Over time, the market filters for evaluators whose reports help the lawyers who hire them. It’s the same pressure that distorts expert witness testimony in other domains, but with higher stakes because children’s living arrangements depend on the output.
The methodology problem
Beyond the financial incentives, the methods evaluators use often lack scientific support for the questions being asked. Psychological tests like the MMPI or Rorschach were developed for clinical assessment, not custody decisions, and their predictive validity for parenting outcomes is weak. Custody-specific instruments like the Bricklin Perceptual Scales have been criticized in peer-reviewed literature for poor psychometric properties. Observational assessments rely heavily on subjective interpretation, and brief interviews are extrapolated into broad characterological judgments. Evaluators often anchor early in the process and confirm their initial impressions through the rest of the work. Independent reviewers asked to assess the same materials frequently reach different conclusions. The fact that the report comes with credentials and a binder doesn’t mean the methodology meets the standard a courtroom usually demands.
What honest reform looks like
Some jurisdictions have started requiring evaluator disclosure of methodology, statistics on prior recommendations, and limits on instruments that lack peer-reviewed support. Court-appointed and court-funded evaluators, removed from the parental retainer relationship, reduce the most direct financial incentive. Standardized protocols, recorded interviews, and explicit reasoning chains all improve transparency. Family courts could also weight evaluator reports as one input among many rather than treating them as near-determinative. None of this requires distrusting clinicians, it requires acknowledging that the role’s structure produces bias regardless of the individual’s integrity.

Custody evaluations operate at the intersection of high stakes, weak methodology, and financial dependence on the parties involved. The research is consistent that recommendations track who hired the evaluator more than the underlying facts of the case. Treating these reports as neutral expert findings, the way family courts often do, gives them more weight than the evidence supports. Honest reform doesn’t blame the evaluators, it changes the structure that produces the bias.
